1. Acceptance of Terms
By using Filmit AI, you agree to these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree to these Terms, please do not use the app.
2. Use of the App
Filmit AI allows you to generate, edit, and customize cinematic-style video content using AI technology. By using the app, you confirm that:
- You own or have obtained all necessary rights, licenses, or permissions to use, upload, and edit any images, videos, or other content you submit;
- You will not use Filmit AI to upload, generate, or distribute any illegal, infringing, defamatory, or otherwise prohibited content;
- You will not use the app to impersonate others or violate any applicable laws or third-party rights, including intellectual property rights.
3. User Content
You retain all ownership and intellectual property rights to the content (including images, videos, and text prompts) that you upload or generate using Filmit AI.
By using the app, you grant Filmit AI a non-exclusive, royalty-free, worldwide license to use, process, and display your content solely for the purpose of providing, maintaining, improving, and securing the app and its AI-powered features.
This license does not grant us the right to sell, redistribute, or publicly exploit your content outside the scope of the service.
4. Facial Data Collection and Use
4.1 What Face Data Does Filmit AI Collect?
Filmit AI may process facial features contained in photos or videos that you voluntarily upload when using features such as photo-to-video generation, subject reference, or AI dialogue with lip synchronization.
The facial data processed may include visual facial characteristics such as facial landmarks, mouth movement, eye position, and expression-related features.
Filmit AI does not collect biometric identifiers used for personal identification, nor does it attempt to identify or verify a user’s real-world identity.
4.2 Purpose of Facial Data Processing
Facial data is processed solely for the following purposes:
- Generating animated video content from photos or videos;
- Enabling natural lip synchronization for AI-generated dialogue;
- Matching facial expressions and head movements with generated speech;
- Maintaining visual consistency of subjects within a generated video.
Facial data is not used for user identification, authentication, advertising, profiling, tracking, or facial recognition purposes.
4.3 Sharing of Facial Data and Storage
Filmit AI may use secure third-party AI processing services to perform real-time facial analysis required to deliver requested video generation features.
- Facial data is transmitted only for processing purposes;
- Neither Filmit AI nor its third-party service providers store facial data after processing is completed, except where temporary retention is technically necessary to provide the requested service;
- Facial data is not shared with advertisers, data brokers, or analytics providers for advertising purposes.
All processing occurs in secure server environments with industry-standard safeguards.
4.4 Face Data Retention Period
Facial data is processed temporarily and in real time.
- Facial data is discarded immediately after the requested video generation task is completed, except where temporary retention is necessary for service delivery, security, troubleshooting, or legal compliance;
- Filmit AI does not retain facial data longer than reasonably necessary to provide the requested feature;
- No long-term storage or reuse of facial data for identification purposes occurs.
If a user deletes their account, any remaining associated personal data will be deleted or anonymized in accordance with this Privacy Policy and applicable laws.
4.5 Refund Requests and Refund Review Data
To ensure fair use of Filmit AI, prevent fraud, comply with applicable laws, and satisfy the requirements of app stores, payment providers, and other authorized entities, we may review account activity associated with refund requests.
When you submit a refund request, you authorize Filmit AI to collect, access, use, retain, and disclose information reasonably necessary to evaluate, process, investigate, and resolve the refund request.
Such information may include:
- Subscription, purchase, and payment history;
- Credits granted, purchased, earned, consumed, forfeited, or remaining in your account;
- Usage records relating to video generation, image generation, editing tools, AI features, and other services;
- Generated content metadata, task history, and related operational records;
- Login records, device information, IP address, account activity, and security logs;
- Transaction records, billing information, and chargeback-related data;
- Any other information reasonably necessary to investigate, process, or defend against refund claims, disputes, or fraudulent activities.
For subscription plans and credit-based services, credit allocations, generated content, feature usage, and account activity may be considered when determining eligibility for a refund to the extent permitted by applicable law.
Filmit AI may share such information with app store operators, payment processors, fraud prevention providers, legal authorities, regulatory agencies, or other authorized third parties when reasonably necessary for:
- Refund review and processing;
- Chargeback investigation and defense;
- Fraud detection and prevention;
- Legal compliance and regulatory obligations;
- Enforcement of these Terms and protection of our rights and services.
Information used for refund review will be retained only for as long as reasonably necessary to process the request, resolve disputes, comply with legal obligations, or protect against fraud and abuse.
Submission of a refund request does not guarantee approval of a refund. Refund decisions may be made by Filmit AI, the applicable app store, payment provider, or other authorized entity in accordance with their respective policies, procedures, and applicable laws.
5. Restrictions
You agree not to:
- Attempt to access, reverse engineer, decompile, disassemble, or otherwise extract the app’s source code, underlying algorithms, or AI models;
- Use Filmit AI for any unlawful, fraudulent, harmful, or unauthorized purpose;
- Upload content that infringes intellectual property rights, privacy rights, publicity rights, or other rights of any third party;
- Interfere with, disrupt, damage, or compromise the functionality, security, integrity, or availability of the app or its services;
- Circumvent usage limitations, subscription restrictions, payment systems, or security measures implemented by Filmit AI.
6. Termination
We may suspend, restrict, or terminate your access to Filmit AI at any time if we reasonably believe that:
- You have violated these Terms, this Privacy Policy, or applicable laws;
- Your use of the service presents security, legal, operational, or reputational risks;
- Such action is necessary to protect Filmit AI, its users, partners, or third parties.
Termination does not affect any rights or obligations that accrued prior to termination.
7. Changes to the Terms
We may update these Terms and this Privacy Policy from time to time.
If material changes are made, we may provide notice through the app, website, or other reasonable means. Continued use of Filmit AI after changes become effective constitutes your acceptance of the revised Terms and Privacy Policy.
